If your children are younger than 19 years old (minor), you should name a legal guardian who you want to care for them if you become unable to or you die.  It is important to name a guardian to make sure your children have continuous care with people they know and who you trust. 

This Child Guardian Appointment form lets you name:

• one donor or two donors
• one guardian or two guardians
• one alternate (back-up) guardian or two alternate guardians.

About the donor(s)

You are the donor or donors — the person or people naming a guardian for their children under 19. You can list one or two donors.
The donor(s) must live in Nova Scotia.

Guardian for the children

The person or people you choose as guardian must be 19 years or older, and must have capacity to make decisions and understand the consequences of their actions.  Talk with them before you name them to make sure they are willing and feel able to take on the job.

If you name a second guardian the two guardians must act together.  This is called acting “jointly”. If one of the two guardians you name is unable or unwilling to act, the remaining guardian may act alone.

Alternate guardian for the children

It is a good idea to name a back-up guardian, if you can. The back-up guardian is called an "alternate guardian". The alternate guardian steps in if the first named guardian(s) will not or cannot act.
